Agreement

By accessing or using boothaster.com, you agree to these terms. If you do not agree, please do not use our website or services.

What we provide

Our website showcases the artwork and creative practice of Booth Aster (Joanne Flinn), including textile sculpture, wing installations, the Vibrations painting series, and related works.

We also offer commissioned artworks, creative discovery sessions, and related services. These are governed by separate agreements provided at the time of engagement.

Intellectual property

All content on this website, including text, images, artwork photography, graphics, logos, and descriptions of creative processes, is the intellectual property of Project Wings Pte Ltd unless otherwise stated. Booth Aster™ and Unicorning® are trademarks of Project Wings Pte Ltd.

You may share links to our content. You may not reproduce, distribute, or create derivative works from our content — including artwork photography — without written permission.

All commissioned artworks remain the intellectual property of Booth Aster until full payment is received, at which point ownership of the physical work transfers to the collector. The artist retains the right to photograph and reproduce images of the work for portfolio, exhibition, and promotional purposes unless otherwise agreed in writing.

Artist resale royalty

Booth Aster's work appreciates in value as a result of the artist's ongoing practice, exhibitions, recognition, and reputation. The resale royalty reflects the principle that the artist shares in the value she has helped create.

Resale royalty. If you resell a work acquired from Booth Aster, a royalty of 5% of the resale price is payable to the artist. This applies to all resales, whether through a dealer, auction house, gallery, or private transaction.

Right of first refusal. Before offering a work for resale, you agree to notify Booth Aster in writing and allow 30 days to respond. The artist retains the right of first refusal to repurchase the work at the proposed sale price.

Notification of resale. You agree to notify Booth Aster of any resale within 14 days of completion, including the sale price and the identity of the new owner. This enables the provenance record to be maintained.

Provenance and authenticity. Booth Aster maintains a provenance record for every work, including the certificate of authenticity, exhibition history, and ownership history. This record protects the value and authenticity of your piece. A sale conducted in accordance with these terms preserves the provenance chain and the artist's endorsement of the work's authenticity.

A sale conducted without notification — or without payment of the resale royalty — breaks the provenance chain. Booth Aster reserves the right to withdraw authentication and provenance support for any work whose chain of ownership can no longer be verified. This is not a penalty — it is a practical consequence. Without a verified ownership record, the artist cannot confirm the work's history, and its provenance becomes incomplete.

Application. This clause applies to the original purchaser and to all subsequent owners. By purchasing a work from Booth Aster, you agree to ensure that these terms are communicated to any future buyer, and that the resale royalty and notification obligations transfer with the work.

Context. Over 90 countries recognise some form of artist resale right in law, including Australia, the United Kingdom, and the European Union. This contractual clause establishes the same principle between artist and collector, reflecting international best practice and the mutual respect that underpins the commissioning relationship.

Use of the website

You agree to use our website only for lawful purposes. You may not use our website to collect personal data of other users, attempt to gain unauthorised access to our systems, or distribute harmful content.

Information, not advice

The content on our website is for general information purposes. While we take care to ensure accuracy, we do not guarantee that all information is complete, current, or applicable to your specific circumstances.

For decisions relating to art investment, we recommend independent professional advice.

Commissions and payments

Where we offer commissioned artworks, creative sessions, or related services, the specific terms — including investment, deliverables, timeline, and cancellation arrangements — will be provided before you commit. Payment constitutes acceptance of those specific terms.

Commission details, creative briefs, and collector information are confidential and are not disclosed to third parties without consent.

Limitation of liability

To the fullest extent permitted by Singapore law, Project Wings Pte Ltd is not liable for any indirect, incidental, or consequential damages arising from your use of our website or services. This includes, without limitation, loss of profits, data, or business opportunity.

Our total liability for any claim arising from commissioned services is limited to the amount you paid for the specific service.

Third-party links

Our website may contain links to third-party websites, including social media platforms and video hosting services. We are not responsible for the content, privacy practices, or availability of these external sites.

Indemnification

You agree to indemnify and hold harmless Project Wings Pte Ltd, its directors, employees, and contractors from any claims, damages, or expenses arising from your breach of these terms or your use of our website or services.

Changes to these terms

We may update these terms from time to time. Changes will be posted on this page with an updated date. Continued use of our website after changes are posted constitutes acceptance of the revised terms.

Governing law

These terms are governed by and construed in accordance with the laws of the Republic of Singapore. Any disputes arising from these terms or your use of our website shall be subject to the exclusive jurisdiction of the courts of Singapore.
